Privacy Policy and Internet Agreement

The Oregon Beverage Recycling Cooperative (OBRC) is contracted to provide operational services associated with San Francisco BottleBank. These services include a mobile application platform and a kiosk platform, through which customers can sign up for BottleBank accounts, conduct account transfers and activities, and participate in the BottleBank program. OBRC is a contracted operator which holds certain account information on its platforms to conduct account functions, and to provide the system’s mobile application and kiosks.

In order to operate a bulk beverage container redemption services with unique and secure customer accounts, OBRC collects names, email addresses, physical addresses, and phone numbers provided by individuals using BottleBank services. This information is used to create unique customer accounts in the BottleBank system, to contact customers regarding their BottleBank accounts, and to verify and validate account information. OBRC shares this information, as necessary, with partners directly involved in the operation and facilitation of BottleBank services, which include (but may not be limited to) Our Planet Recycling, SF BottleBank, the San Francisco City/County Department of the Environment, and the San Francisco Conservation Corps, and with companies that facilitate customer financial transactions/transfers out of BottleBank accounts. In the case of companies facilitating customer financial transactions out of BottleBank accounts, please see the Terms and Conditions and Privacy Policies for those companies. Customers may be asked to provide a date of birth while facilitating financial transactions/transfers out of their BottleBank accounts. In these cases that information is used by the third-party companies facilitating financial transactions to verify customer accounts, and OBRC does not keep or store this information.

OBRC/BottleBank may utilize Hyperwallet payment services to deliver payments to you. Such payment services are subject to the Hyperwallet Terms of Service and the Hyperwallet Privacy Policy.

Customers wishing to view their personal information collected by OBRC may do so by securely logging in to their accounts through the BottleBank App, or through a BottleBank kiosk. The secure login function helps ensure that this personally identifiable information is only shared with the correct individual. Customers experiencing login difficulties may contact Customer Service at 1-833-732-6885 to verify and gain access to their accounts. On these platforms, customers are able to see the name, email address, phone number, and physical address associated with their accounts and are able to make changes to their name, email address, and physical address. Customers may make changes to their phone number by contacting Customer Service at 1-833-732-6885.

The account log-in and information viewing and changing processes described above fulfill customer data subject access requests. Customers with additional questions about accessing their data may contact Customer Service at 1-833-732-6855.

The BottleBank web and mobile application platforms provided by OBRC do not monitor or track individuals across multiple websites or online platforms to build a profile of behavior and interests, and do not make personally identifiable information available to third parties to collect via a website or online service (except as noted above, and as it relates to analytics tools like Facebook and Google Analytics). OBRC and BottleBank may collect analytical data and statistics about activity on their online platforms, and share information, in aggregate, with operational partners and interested parties to monitor and report on program growth metrics, sign-up volume, and program activity.

This Privacy Policy is easily accessible through the BottleBank mobile app and website and does not require customers to be logged in to accounts in order to view it, and is included in the BottleBank Terms and Conditions, which are accessible through the mobile app, website,  and viewable on BottleBank kiosks. When changes are made to the Terms and Conditions (including the Privacy Policy) BottleBank customers are notified when they log in to their BottleBank accounts via the mobile app, website, or a BottleBank kiosk. This Privacy Policy is effective upon launch of the program.

Customer agrees that since the Internet is not a fully secure medium for the communication of information, and since privacy and confidentiality cannot be guaranteed, use of BottleBank’s services may cause the customer’s information to be accessed by, or disclosed to, other persons. Therefore, the customer agrees OBRC and BottleBank shall not be responsible or liable for damage that the customer, or any other person, may suffer in connection with the communication of private, confidential, or sensitive information using BottleBank’s services.

Additionally, customer agrees not to engage in the following:

Abusive Conduct

Giving false information to obtain access to company’s system and/or purchase and/or utilize any service (including but not limited to redemption or attempted redemption of containers not subject to the CRV program). Knowingly providing false, fictitious, or misleading customer information (name, address, etc.), or otherwise intentionally misrepresenting oneself. Utilizing a BottleBank account(s) in any way which is not consistent with the intended use of returning containers for redemption, and/or creating or using more than two (2) accounts per household. Engaging in any illegal, criminal, or malicious activities. Any other activity or activities that BottleBank, in its sole discretion, determines is unethical or damaging to our other customers, users of the internet, BottleBank’s network, or to BottleBank’s corporate reputation.

Account Abuse

Defined as those many and varied activities that would commonly be termed abusive by computer professionals. These would include, but are not limited to: modification of, or tampering with, files not owned by the user. Attempts to examine files that contain sensitive information not normally to be viewed by system users. Attempts to reduce the systems resources not normally available to users. Attempts to reduce the systems security, or to hamper the normal functioning of the system. (Note: the modification of sensitive files is considered acceptable when occurring under the normal function of common user programs designed to modify or examine those files, such as password program.) Attempts to violate the law. Attempts to misuse proprietary information, intellectual property, or property of others for their own purposes. If there is reasonable grounds to believe that a container was not purchased in California, BottleBank may request proof of purchase or refuse to accept the container.

THIS TERMS OF SERVICE AGREEMENT (THE “AGREEMENT”) ESTABLISHES THE TERMS AND CONDITIONS THAT APPLY TO ALL END USERS (EACH AND COLLECTIVELY, “YOU”, “YOUR”, OR “USER”) OF THE SITE AND/OR SERVICE (EACH AS DEFINED BELOW). BY USING THIS SITE AND/OR SERVICE, YOU ARE INDICATING YOUR ACCEPTANCE OF THIS AGREEMENT AND YOUR AGREEMENT TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT, AS WELL AS ALL APPLICABLE LAWS AND REGULATIONS. YOU ARE NOT PERMITTED TO USE THIS SITE AND/OR SERVICE IF YOU DO NOT AGREE TO ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT. THIS AGREEMENT CAN BE CHANGED, MODIFIED, SUPPLEMENTED, AND/OR UPDATED BY BOTTLEBANK AT ANY TIME. YOUR CONTINUED USE OF THE SITE AND/OR SERVICE AFTER THE MODIFICATION OF THIS AGREEMENT MEANS THAT YOU ACCEPT ALL SUCH CHANGES. ACCORDINGLY, YOU ARE ADVISED TO CONSULT THIS AGREEMENT EACH TIME YOU ACCESS THE SITE AND/OR SERVICE IN ORDER TO VIEW ANY CHANGES TO THIS AGREEMENT. THIS AGREEMENT WAS LAST MODIFIED AS OF THE DATE INDICATED ABOVE.

By using this Site/Service, you signify your acceptance of these terms. If you do not agree to these terms, please do not use our Site/Service. Your continued use of the Site/Service following the posting of changes to these terms will be deemed your acceptance of those changes.

Your Acceptance of These Terms

BottleBank management reserves the right, at its sole discretion, to change these terms or the fees associated with BottleBank accounts or other BottleBank services at any time. Best efforts will be made to notify all customers and account holders of any changes to fees or account terms and conditions. Customers are responsible for keeping their account information up to date.

By signing up for a BottleBank account, you signify your acceptance of these terms. If you do not agree to these terms, please do not use a BottleBank account. Your continued use of the BottleBank account following the posting of changes to these terms will be deemed to be your acceptance of those changes.
